TERMS AND CONDITIONS

 

Introduction 

 

Welcome to www.shop-kitchenmilano.com, the online store of KITCHEN srl, registered in Milan, 20123, via Edmondo de Amicis 45, registered in the Ordinary section of the company registries with VAT number 03941140968.

The products purchased on www.shop-kitchenmilano.com are sold directly by KITCHEN Srl.

 

Before submitting an order, we invite you to carefully read the Terms and Conditions as well as the Information on the Right of Withdrawal. 

In this section we will refer to  KITCHEN Srl as the Seller while the Customer is the over 18 years of age person who purchases products on www.shop-kitchenmilano.com.

 

Placing an order

 

 1. The Customer must be registered on the site. This is achieved by filling out the form available on the www.shop-kitchenmilano.com website and following the instructions.

 

2. When placing an Order, the Customer may only purchase Products present on the www.shop-kitchenmilano.com website as described in the appropriate information sheets. The technical information on the website faithfully reproduces that provided by the manufacturers. This information may be updated at any time to bring it in line with that provided by the manufacturers. The image accompanying the description of a Product may not be representative of its characteristics: the Product ordered may differ in colour, size, accessories, etc. from the photo.

In case of uncertainty about the choice or the information on the website www.shop-kitchenmilano.com, the Customer is invited to contact Customer  Service by writing to info@kitchenmilano.it.

 

3.  After verifying the contents of the Order in the Shopping Cart, by clicking on the Buy button the Customer places the Order and therefore declares to accept these General Conditions of Sale in full and without reservation. The order is considered accepted after payment has been received.

 

4. The prices on the website www.shop-kitchenmilano.com are all expressed  VAT included, except in cases where the country of destination is outside the EU. Prices may change at any time except in the case of an Order already placed.

 

Payment

 

1.  Orders can be paid by credit card (Visa, Mastercard and American Express) or PayPal.

2. In the case of payment by credit card, the Order shall only be considered ready for shipment after the credit card payment has been approved.

3. In case of a PayPal payment, it is considered accepted only when the Customer receives the email from PayPal regarding the transaction having gone through successfully.

Update of Paypal Terms and Conditions beginning March 5th, 2020

 

A refund for returned merchandise regarding a purchase on the www.shop-kitchenmilano.com website previously paid for using PayPal as the payment method, will be granted only to the original purchasing client. The refund will not include the fees retained by PayPal (equal to a fixed amount of 0.35 euros + a variable amount from 2.2% to 4.4% of the amount paid). The refund will be of the NET transaction amount only.

The only exception, under which the seller will waive PayPal fees, is if the buyer accepts a shopping voucher instead of a refund to be used on the www.shop-kitchenmilano.com site for future purchases. In this case the Seller ensures that no deduction of the PayPal fees will be applied.

 

4. To guarantee greater security in the processing of personal data, the Seller does not store Customer’s bank details. The Customer shall therefore be required to record and/or print out the payment details if he/she wishes to keep track of the transaction.

 

Shipping

 

In the city of Milano, delivery is expected within 24 hours after payment of the order.

In most other Italian locations and for products in stock, delivery is normally within 2/5 working days from receipt of payment.

Delivery times abroad are calculated according to the country of destination at the time the order is placed.

For products made to order or not in stock, delivery has a variable waiting time depending on the type of product, the quantity requested, the size, the colour, etc. In this case, delivery is expected within 20 working days from payment of the order

 

If it is not possible to respect the timeframe, the Seller will communicate via email to the Customer, who will have the right to:

- cancel the Order and be reimbursed for any amount already paid and the refund will be made within 7 days from the cancellation of the order, or

- exchange the product ordered, or

- accept the delay beyond the time initially indicated.

The Customer may authorise a partial delivery of the order placed that respects the indicated timeframe and via a subsequent written communication the Seller will notify the Customer of the status regarding the missing products.

The shipment date that the Customer finds on the order processing email indicates the day in which the Seller entrusts the order to the courier for delivery to the address indicated.

The Customer can follow the shipment through the tracking code provided.

The delivery times indicated are those guaranteed by the couriers in normal situations and do not take into account extraordinary events (strikes, particularly intense holiday periods, weather events, etc.). 

 

Delivery costs

 

The Seller relies on the following delivery companies:

DeliverMi for deliveries to Milano City and DHL for deliveries in the rest of Italy and abroad

For all orders, shipping costs include a fixed rate of 15 euros.

The cost of shipping abroad will be calculated at the time of receipt of the order and will be determined based on the weight of the products purchased and country of destination.

The Seller is not responsible for the loss or damage of the products covered by the Order, at the time of delivery to the carrier.  Without prejudice to the consumer's rights towards the carrier if the loss or damage to the product is attributable to the latter.

If the delivery is rejected, not picked up or the communicated address is incorrect, all costs related to storage, return and redelivery will be charged to the Customer.

The Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the packaging is intact and whose Scotch tape has not been tampered with.  Any inconsistency must be contested in writing to the carrier by signing the delivery document received by the courier with the wording "GOODS INSPECTION RESERVE".

Should this occur, the Customer must report the dispute within 5 working days by email to info@kitchenmilano.it

Upon receipt of the Customer's e-mail, the Seller will ask the courier to open a transport damage case.

Upon the acknowledged of damage by the transportation carrier, the Seller will order a replacement product or refund its value.  Any additional transportation costs will be the Seller’s responsibility.

If the Customer accepts the Product and signs the transport document without indicating the necessary reservations referred to above, the right to  subsequently claim any shortages or damage is automatically relinquished.

 

Delivery

 

The Seller delivers the products throughout Italy and abroad.

1. Place of delivery

 The delivery of the purchased Products takes place at the postal address specified by the Customer in the Order form ("Shipping Address").  An extra supplement may be requested by the transport company for deliveries in disadvantaged areas (smaller islands, dirt roads, narrow or difficult locations to reach).

 1.1 The Customer will be notified of the shipment by e-mail

 1.2 In the event the Customer is absent on the day, time and place agreed with the delivery company the goods will be deposited in the local warehouse of the company. According to the specific service provided by the courier, a second delivery attempt can be made.  In the event that the second delivery attempt fails, or in the event that the Customer does not respond to the contact attempt, the goods will be returned to the Seller and the Customer will be notified of this circumstance by e-mail.

The Customer acknowledges that, after fifteen (15) days from the date the package is returned to the Seller, the Purchase Order will be canceled pursuant to art.  1456 of the Italian Civil Code.

At this point the Seller will reimburse the amount paid by the Customer, deducting the costs of the unsuccessful delivery of the order, the costs of returning the order to the Seller, the costs of storing the order, the administrative costs and order management equivalent to 10% of the order value.

The amount to be refunded will be communicated to the Customer via e-mail and will be credited to the same payment solution used by the Customer for the purchase, after verifying the integrity of the Product.

 1.3 The storage costs depend entirely on the delivery company. These costs are calculated starting from the day following the unsuccessful delivery or after fifteen (15) days of availability of the Products.

 1.4 In the event that, before the expiration of the terms, (15) days, the Customer requests to receive the Order again, the Seller will proceed with the new delivery, after charging, in addition to the costs thereof, the costs of returning the Products to Seller.

 1.5 The Seller cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the completion of the purchase order by the Customer (incomplete or incorrect address, incorrect telephone number, etc.).

 1.6 The Seller will also not be held responsible for any damage that may have occurred to the Products after entrusting the delivery company responsible for transporting them, as well as for delays in delivery attributable to the latter.

 

Right of withdrawal 

 

 In accordance with art.  52 of the Legislative Decree no. 206, September 6th 2005  (the "Consumer Code"), the Customer has the right to withdraw from the purchase agreement signed with the Seller without any penalty and without the need to provide a reason, within 14 days from the days of receipt of the products purchased on www.shop-kitchenmilano.com

To exercise the right of withdrawal, the Customer must send a specific email request to info@kitchenmilano.it containing the following information:

 • Name and surname or company name;

 • Order reference, date and number;

 • List of the items to be returned (it is sufficient to indicate the product code and the quantity);

 • Bank details (IBAN and account holder’s name)

In accordance with art. 57 of the Consumer Code, once the right of withdrawal has been exercised, the products to be returned must be in the hands of the delivery company within fourteen (14) days from the date in which the Customer communicated to the Seller the decision to withdraw from the contract.

 

The products must not have been used, washed etc, and must not have been damaged.

The products must be returned in their original packaging complete of all its parts (packaging, documentation and accessories).

 

The Product, properly protected and packaged, must be sent to the following address:

If the Customer has complied with all the required conditions, the Seller, in accordance with art. 56 of the Consumer Code, will fully reimburse the price of the products purchased. The Customer will remain however responsible for the transport or delivery costs of the return.

 

The shipment of the product to the Seller, up until the signature of receipt in the warehouse of the Seller, will remain under the complete responsibility of the Customer, who will be required to pay compensation for damage to the Seller in the event of an accident, without prejudice to the carrier's liability.  Therefore, in the event of damage or loss of the returned goods during transport, the Seller will notify the Customer of the incident (within 5 working days of receipt of the goods), to allow the latter to promptly file a complaint against the carrier chosen by the Customer and obtain reimbursement of the value of the goods (if insured).

In accordance with the provisions of art.  57, paragraph I, Consumer Code, only after receipt of the Product and after having positively verified compliance with the terms and conditions for exercising the right of withdrawal as well as the substantial integrity of the product and packaging as specified above, the  Seller will proceed, as quickly as possible and in any case no later than fourteen (14) days, to refund the sums paid by the Consumer. The refund amount will be communicated via e-mail and credited to the same means or payment solution used for the purchase.

The right of withdrawal is excluded in the event that the customer has purchased customized products and therefore impossible to resell.

 

Returns

 

In the event that the Customer returns previously purchased products (subject to authorization by Kitchen Srl, the Customer will have to arrange for the shipment (at their own expense) exclusively to the operational headquarters in the manner that will be communicated. Unauthorized return shipments will not be accepted and will be returned to the sender.

Any damage must be strictly reported within 7 days of receipt of the goods.
